Terms & Conditions

Summary: These terms govern your use of SponsorPro's compliance management platform. By using our service, you agree to use it lawfully, maintain accurate data, and pay applicable subscription fees. We provide tools to assist with compliance, but you remain responsible for meeting your legal obligations.

1. Agreement to Terms

By accessing or using SponsorPro ("the Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you are using the Service on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, you must not use the Service.

2. Description of Service

SponsorPro is a compliance management tool designed to help UK employers:

  • Track and organise Right to Work check records and documentation
  • Monitor Sponsor Licence compliance deadlines
  • Receive reminders for visa expiry dates and follow-up checks
  • Generate compliance reports and maintain audit trails
  • Store and organise worker documentation securely

Important Regulatory Notice:

SponsorPro is a compliance management tool, not an immigration advisory service. We do NOT provide immigration advice or immigration services as defined by the Immigration and Asylum Act 1999.

SponsorPro is NOT regulated by the Office of the Immigration Services Commissioner (OISC) / Immigration Advice Authority (IAA), the Solicitors Regulation Authority (SRA), or any other designated professional body under the 1999 Act.

Any information, guidance, checklists, or tools within SponsorPro are based on publicly available Home Office guidance and are provided for general informational purposes only. They do not constitute advice specific to any individual's immigration circumstances.

For immigration advice specific to your workers or your organisation's circumstances, you should consult a qualified immigration adviser regulated by the OISC/IAA, a solicitor, barrister, or other legal professional authorised to provide immigration advice.

You remain solely responsible for ensuring your organisation's compliance with UK immigration law.

3. User Accounts

3.1 Account Creation: To use SponsorPro, you must create an account with accurate and complete information. You must be at least 18 years old and have the legal authority to enter into this agreement.

3.2 Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must immediately notify us of any unauthorised access.

3.3 Account Types: Depending on your subscription, you may have access to different features and user limits. Account administrators are responsible for managing user access within their organisation.

4. Subscription and Payment

4.1 Free Trial: New accounts receive a 7-day free trial with access to all features. No payment details are required during the trial period.

4.2 Subscription Plans: We offer the following subscription tiers:

  • Right to Work Starter: £39/month (up to 25 workers, 1 user)
  • Right to Work Professional: £69/month (up to 100 workers, 5 users)
  • Sponsor Starter: £79/month (up to 50 workers, 3 users)
  • Sponsor Professional: £149/month (up to 250 workers, 10 users)
  • Sponsor Business: £249/month (up to 500 workers, 25 users)
  • Enterprise: Custom pricing (unlimited workers and users)

4.3 Billing: Subscriptions are billed monthly or annually in advance. Annual subscriptions receive a discount. All prices are in GBP and exclusive of VAT where applicable.

4.4 Payment Methods: We accept major credit/debit cards via our secure payment processor (Paddle). Your payment details are handled securely and never stored on our servers.

4.5 Failed Payments: If a payment fails, we will notify you and provide a grace period to update your payment method. Continued failure may result in service suspension.

5. Cancellation and Refunds

5.1 Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

5.2 Refunds: Monthly subscriptions are non-refundable. Annual subscriptions may be eligible for a pro-rata refund within the first 30 days if you are dissatisfied with the service.

5.3 Data After Cancellation: Upon cancellation, you will have 30 days to export your data. After this period, your data will be permanently deleted in accordance with our Privacy Policy.

6. Acceptable Use

You agree to use SponsorPro only for lawful purposes and in accordance with these Terms. You must NOT:

  • Use the Service to violate any applicable law or regulation
  • Upload false, misleading, or fraudulent information
  • Attempt to gain unauthorised access to other accounts or systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated tools to scrape or extract data from the Service
  • Resell, sublicense, or redistribute access to the Service
  • Upload malicious code, viruses, or harmful content
  • Use the Service to discriminate unlawfully against workers

7. Your Responsibilities

As a user of SponsorPro, you are responsible for:

  • Data Accuracy: Ensuring all worker data you enter is accurate and up-to-date
  • Legal Compliance: Meeting your legal obligations as an employer under UK immigration law
  • Document Verification: Properly verifying original documents before recording checks
  • Timely Action: Responding to reminders and completing checks by required deadlines
  • Data Protection: Complying with GDPR and data protection laws regarding worker data
  • User Management: Appropriately managing access for users within your organisation

8. Intellectual Property

8.1 Our Property: SponsorPro, including its design, features, code, and content, is owned by SponsorPro and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8.2 Your Data: You retain ownership of all data you upload to SponsorPro. By using the Service, you grant us a limited licence to process your data solely to provide the Service to you.

8.3 Feedback: If you provide suggestions or feedback, you grant us the right to use this feedback to improve our Service without compensation to you.

9. Service Availability

9.1 Uptime: We strive to maintain high availability but do not guarantee uninterrupted access. We may need to perform maintenance, which we will schedule during off-peak hours where possible.

9.2 Modifications: We may modify, update, or discontinue features of the Service. We will provide reasonable notice of significant changes that may affect your use.

9.3 Force Majeure: We are not liable for service disruptions caused by events beyond our reasonable control, including natural disasters, power outages, or cyber attacks.

10. Limitation of Liability

10.1 Service Limitations: SponsorPro is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will meet your specific requirements or be error-free.

10.2 No Legal or Immigration Advice: SponsorPro does not provide legal advice or immigration advice as defined by the Immigration and Asylum Act 1999. Any guidance, checklists, wizards, or informational content are based on publicly available Home Office guidance and are for general informational purposes only. Immigration rules change frequently; always verify current requirements at GOV.UK. For advice specific to your circumstances, consult a qualified immigration adviser registered with the OISC/IAA or another authorised legal professional.

10.3 Liability Cap: To the maximum extent permitted by law, our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10.4 Exclusions: We shall not be liable for:

  • Penalties, fines, or legal consequences arising from your non-compliance
  • Loss of business, revenue, or profits
  • Data loss caused by your actions or third-party services
  • Indirect, incidental, or consequential damages

11. Indemnification

You agree to indemnify and hold harmless SponsorPro, its owners, employees, and agents from any claims, damages, or expenses (including legal fees) arising from:

  • Your breach of these Terms
  • Your violation of any applicable law
  • Your negligence or wilful misconduct
  • Content or data you upload to the Service

12. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws including UK GDPR. By using the Service, you acknowledge that you act as a data controller for worker data you process through SponsorPro.

13. Termination

13.1 By You: You may terminate your account at any time by cancelling your subscription and deleting your account.

13.2 By Us: We may suspend or terminate your account if you:

  • Breach these Terms
  • Fail to pay subscription fees
  • Engage in fraudulent or illegal activity
  • Abuse the Service or our staff

13.3 Effect of Termination: Upon termination, your right to use the Service ends immediately. We will retain your data for 30 days to allow export, then permanently delete it.

14. Dispute Resolution

14.1 Governing Law: These Terms are governed by the laws of England and Wales.

14.2 Jurisdiction: Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14.3 Informal Resolution: Before initiating legal proceedings, you agree to contact us at legal@sponsorpro.co.uk to attempt informal resolution.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Your continued use after changes become effective constitutes acceptance of the new Terms.

16. General Provisions

16.1 Entire Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and SponsorPro.

16.2 Severability: If any provision is found unenforceable, the remaining provisions shall continue in effect.

16.3 No Waiver: Our failure to enforce any right or provision does not waive our right to enforce it later.

16.4 Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights to a successor in case of merger or acquisition.
